Definition of the contract
The supply contract for the goods shown on our website www.mybestway.it, stipulated between the company My Best Way srl Via Largo piano, 15 - 89058 Scilla (RC) Italia - VAT number 03059340806 (di seguito menzionata come Fornitore) and the Customer must be considered concluded only at the time of acceptance, even if partial, the order by the site owner. Acceptance of the order of Customer is deemed to have occurred only if communicated by E-mail by the Supplier.
The Customer, with the electronic sending of the confirmation of his purchase order, declares to have become aware of all the information provided to him during the purchase procedure and to fully accept the general and payment conditions below transcribed. Any right of the Customer to any kind of is excluded compensation for damages or compensation, as well as any contractual liability or non-contractual for direct or indirect damage to people and / or things caused by failure to accept, even partially, an order.
The Customer undertakes to print or save an electronic copy and in any case to keep it these general conditions of sale, in compliance with the provisions of art. 3 and 4 of Legislative Decree 185/1999 on distance selling.
All sales prices of the products present and indicated within the site www.mybestway.it and as such constitute an offer to the public pursuant to art. 1336 of the Civil Code, include VAT. Prices include shipping and packaging (where applicable). These prices may change at any time without the Supplier being obliged to give any notice; in any case, once the order of the product has been placed, it will not undergo any price change.
The availability of the products refers to the one present at the time the Customer consults the product data sheets; this must however be considered purely indicative because, due to the simultaneous presence of multiple users on the site, the products could be sold to others before the order is confirmed.
Also following the sending of the order confirmation e-mail by of the Supplier, there may be cases of partial or total unavailability of the goods. In this case, the Customer will be promptly informed and will be able to decide whether to accept the delivery of only the available products or request the cancellation of the order by communicating it via e-mail to the customer service.
Terms of payment
Any payment by the Customer can only be made through one of the methods indicated on the site www.mybestway.it. The following payment methods are accepted:

As soon as the payment is credited to the bank (1/3 working days depending
of the Credit Institution) we will arrange the order and the
shipment of the goods. We recommend that you notify us of the payment,
by mail to email@example.com attaching a copy of the transfer or the CRO number
that the Bank provides for this operation.
Shipping and invoicing methods
Orders received correctly and complete with all the necessary data are processed and normally shipped within the second business day following receipt. In the case of payment by bank transfer, the order will be processed as soon as the customer gives notice of payment, by email firstname.lastname@example.org attaching a copy of the transfer or the number of CRO that the Bank provides for this operation.
Outgoing orders are shipped every day from Monday to Friday. For shipping www.mybestway.it uses the best and most reliable couriers national to guarantee punctual shipments at competitive prices. Delivery times of the courier are usually 3/4 working days from the date of delivery to product transporter. Deliveries will be made by express courier (at the door or at the intercom), at the address indicated by the Customer at the time of the order.
Shipping costs will be calculated automatically when ordering based at weight www.mybestway.it will issue an accompanying invoice for the goods shipped. For the issue of the invoice, the information provided by the consumer applies at the time of the order. The invoice, in digital format, will be sent to the Customer at the Email address indicated when ordering.
If the courier does not find anyone at home, he / she leaves a notice of passage indicating the telephone number of the branch to contact for delivery. The next day the courier makes a second delivery attempt and if he again finds no one at home he leaves a second notice. At this point the package is in stock for 7 days within which the customer has two alternatives:
• go and collect it at the address indicated on the notice;
• decide to have it brought back home for the third time by paying, at the time of delivery, a surplus for the stock.
Should the courier deliver the package in the hours when you are not at home, it is important to contact him immediately, to avoid having to pick up the package at the deposit and pay stock. Once the stock is completed (7 days) the parcel returns to the sender.
If you wish to be returned the shipping cost is increased by previous shipment (in practice you pay twice the shipping cost).
Right of withdrawal
Pursuant to art. 5 DL 185/1999, if the customer and a customer have the right to withdraw from the purchase contract for any reason, without need to provide explanations and without any penalty, except as indicated in this article.
It is specified that this right is reserved exclusively to natural persons, a those consumer customers who, as defined in Article 1, purchase the goods for purposes unrelated to and unrelated to their professional activity. It is not provided for the right of withdrawal to professional clients, natural or legal persons, that act in reference to the purchase contract in a professional context.
To exercise this right, the Customer must indicate to the Supplier the intention to withdraw, within 10 working days from the date of receipt of the goods.
This communication must be sent by registered letter with acknowledgment of receipt addressed to:

or by telegram or email always sent within the aforementioned 10-day deadline and followed by a confirmation by registered letter with acknowledgment of receipt, sent within the next 48 hours.
Once the aforementioned withdrawal notice has been received, the Supplier will inform the Customer of the instructions on how to return the goods, intact and in the original packaging, which must take place within the following 48 hours.
In any case, the right of withdrawal is subject to the following conditions:
• this right applies to the product purchased in its entirety, it is not it is possible to exercise withdrawal only on part of the purchased product;
• the goods purchased must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment), without any lack.
The shipping costs for returning the goods are entirely borne by the Customer.
Therefore, please do not send cash on delivery or freight collect, otherwise they will be automatically rejected.
The goods, up to the certificate of receipt in the Supplier's warehouse, is under the full responsibility of the Customer.
In any case, the Supplier is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.
The Supplier, in case of withdrawal, will reimburse the Customer the full amount already paid, within 14 days from the date of receipt of the goods. It will be the Customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN - Cod. ABI - CAB - Bank account - CIN code of the invoice holder).
The right of withdrawal is lost for lack of the essential condition of integrity of the good (packaging and / or its content), in cases where the Supplier ascertains:
• the absence of the external and / or original internal packaging;
• the absence of integral elements of the product;
• damage to the product for reasons other than transportation.
In case of forfeiture of the right of withdrawal, the Supplier will return to the Customer sender the good purchased, charging the same shipping costs.
N.B. For any legal dispute, only the Court of Palmi will be competent.
Pursuant to and for the purposes of art. 14 of the EU regulation n.524 / 2013, consumers resident in the States belonging to the European Union are informed that for the resolution of disputes relating to this contract and the online services offered by this site, there is the possibility of resorting to the proceedings of Online Dispute Resolution (ODR), provided by the European Commission, reachable at the following link: https://webgate.ec.europa.eu/odr/
